Deferred Payment Plan Guidelines and Fine Options Program

 

In accordance with Virginia Code Section § 19.2-354(C) all defendants assessed with fine or costs are eligible to participate in the "Fine Options Program" through Culpeper County Criminal Justice Services (CJS) to perform community service work to earn credits against the fine or costs.

In order to participate in the "Fine Options Program" the defendant shall request permission from the Court to do so. The Court shall document that the defendant is allowed to participate in the program and provide notice to CJS. Once given permission to participate, the defendant shall sign a time to pay with the Clerk. The Clerk shall determine the total amount af fine or costs due and establish the payment plan. The defendant is then to report to CJS, 155 W. Davis Street, Suite 200, Culpeper, Virginia, with the Court's order allowing participation in the program and the payment plan. CJS shall assign the defendant to a community service site at a rate consistent with the payment plan. The defendant must return the community service verification sheet to CJS at least ten {10) days prior to the due date of the fine or costs, in order for CJS to verify the community service hours performed and notify the Court of credit to be given. The defendant will be given credit of $12.00 for every verified hour completed. CJS shall not pursue the defendant if the defendant fails to return community service verification sheet and the Court will only be provided notice of verified community service completion. The defendant may be removed from a community service site for noncompliance of community service site rules, regulations, and/or behavior. If the defendant is removed from a community service site unsuccessfully, another site will not be assigned and the Court will be notified of such.
