Yes, but there are many factors involved, and it depends on what zoning district you are seeking to locate the home in. First, keep in mind that modular homes which are constructed to meet the Virginia Statewide Building Code are treated just as any stick built home would be, and as such, they are permitted in most zoning districts. Manufactured homes, commonly called mobile homes, which do not meet building codes, but do meet HUD standards, are permitted only in the A‐1 (Agricultural) district. It does not matter if a manufactured home is placed onto a permanent foundation, it is still limited to the A‐1 zone for use as a permanent single family dwelling. There are certain hardship conditions which, if met, can qualify manufactured homes for use with a special use permit. Please contact the Planning and Zoning Office for details.
There are many factors that go into answering this question, such as the zoning of the property, whether there will be outdoor storage and whether customers of the business would have to come to the home. Generally, home businesses can usually be approved as a “home occupation” as long as there are no employees other than family members residing in the home; there is no signage; and the business utilizes no more than 25% of the floor area in the home. Although the County does not require a business license, it is critical that the Planning and Zoning Office be consulted before starting any type of business in Culpeper County.
If you are the defendant, you have a right to remain silent, and the judge and jury are not allowed to hold your silence against you. If you are a witness or victim, however, you must testify. If you have concerns about testifying, talk to the prosecutor or the crime victim assistance coordinator in the case.

You do not need a lawyer to file for a preliminary protective order. The Juvenile Services Intake Unit will provide assistance to help you complete the necessary paperwork and will provide basic information about preparing for your court hearing. The unit, however, cannot give you legal advice. You may want to hire a lawyer to represent you at your full hearing (where both parties are before a judge), especially if the person from whom you want protection will have a lawyer.
Generally, yes. A land disturbance permit is required when you are planning to disturb 10,000 square feet or more of land. There are exceptions, such as agriculture, but there are also instances where a permit is required to disturb as little as 5,000 square feet (in the Lake Pelham/Mountain Run Lake Watershed, for example). It is best to contact the Planning and Zoning Office to inquire before disturbing any substantial amount of your land.
Residential storage sheds do not require a building permit provided that they are 256 square feet or less and the structure not intended for vehicle storage.They will however still require a Zoning Permit. This permit will indicate setbacks from property lines, which are applicable to any structure.

The GIS is not survey accurate. The system was built originally from tax map data and aerial photography. As new surveys are done they are entered and inaccuracies are rectified to the extent practicable, but you should not rely on the GIS to determine property line setbacks or other such measurements. The GIS is updated with new data on a quarterly basis, so it is fairly up to date. If a new lot is created, it should be reflected on the site within three months, or in some cases, much sooner, depending on the timing of recordation versus the quarterly update.

By Judges in the Juvenile and Domestic Relations / General District / Circuit Court located in Culpeper County. CCCJS will also accept valid transfers from other in state community corrections program.
You can call 727-3441. You will need to know the defendant's name, and, if possible, the date of the next hearing. The prosecutors are often in court all day, so please be prepared to leave a message with a phone number where you can be called before 4:30 p.m. Please note: If you are charged with an offense and have an attorney, a prosecutor will not speak with you. Have your attorney contact the prosecutor.
At arraignment the judge will determine whether your income makes you eligible for a court-appointed attorney.
If you have suffered a monetary loss, such as damage to your home or medical bills, because of a crime committed against you, the judge may order restitution in the amount of your loss if the defendant was found guilty. Please note that restitution is not ordered for lost work hours.
Driveways and fences can be right up to the property line as long as they do not encroach on the neighboring property. However, it is recommended that fences and driveways be kept a few feet inside the property line for maintenance purposes.

Full payment is required at the time of registration unless otherwise stated in the activity description.
You may purchase your dog license/tag by mail, or in person at the Treasurer’s office at 151 N Main Street, or in person at the Department of Animal Services at 10144 James Monroe Highway. You must present evidence of vaccination and pay a licensing fee. The fee for a Lifetime Dog tag is $10.00. Any person running a commercial dog kennel or keeping dogs in a kennel enclosure may apply for kennel license tags. Kennel license tags are sold in blocks of ten (10) for $50.00 and are available only at the Treasurer’s office. Evidence of vaccination for each dog must be presented. If the number of dogs owned is less then ten, the remainder of the tags will be held in the Treasurer’s Office until additional dogs are acquired.

Yes. Anyone, regardless of residence can participate after they register and meet the age requirements.
The most common issues to be reviewed by the Planning Commission are site plans, major subdivisions, use permits and rezonings. If you need to make an application, the staff will assist you with the details of what is required. Generally, the first Monday of each month is a deadline to apply for the following months Planning Commission meeting. No application will be accepted for placement on the Planning Commission agenda until it is complete, which in many cases means that it first must have the approval of outside agencies such as VDOT and the SWCD.
- If a participant needs to withdraw from a program, a full refund will be issued if the Parks and Recreation Department has been notified in writing (parks [at] culpepercounty.gov (email)) before the start of the second class. Unless otherwise stated in the program description
- Refunds for one-day activities and all bus/van trips will be given in full, prior to the registration deadline (the Register By date). After the registration deadline, refunds less a $3 processing fee, are only given if a substitute(s) is found and that substitute(s) registers with the Department before the activity/trip date.
There is no fee for filing a Family Abuse Protective Order.

The usual conditions often include the following:
• Keep the peace, be of good behavior, and not violate any municipal, county, state, or federal laws and ordinances.
• Follow CCCJS staff’s instructions and be truthful and cooperative
• Not to illegally use, possess, or distribute narcotics, dangerous drugs, controlled substances, or drug paraphernalia.
• Meet with your local probation officer as instructed
• Comply with all court ordered requirements
Culpeper County has an Abandoned Vehicle Ordinance and we also have County Code provisions addressing solid waste. These provisions allow for storage of vehicles under certain circumstances, and with regard to solid waste, “one man’s trash is another man’s treasure” sometimes applies. In other words, call the Planning and Zoning Office with any complaint you have. We will have someone visit the site and determine if a violation exists. If it does, we will take appropriate enforcement action. You can also file a complaint online using the “Zoning Complaint” link to a form on our website.
Good behavior, when ordered by the court, means that you will keep the peace and not violate municipal, county, state, or federal laws or ordinances.
- Proof of Residence: You must submit documentation to verify the address where you physically live. (VA Driver’s License, residence lease, recent mail, or other identification with current address).
- Proof of Employment/School: You must submit documentation to verify your employment or school attendance (pay stubs, direct deposit slip, check, or school schedule with student registration).
- Probation Supervision Fee: You are required to pay a supervision fee for your placement with CCCJS. The fees are due within 30 days of your intake appointment in the form of a money order or cashier’s check made payable to the Treasure of Culpeper County. Fees vary and will be discussed with you at intake
The 'Register By' date is the date at which the minimum number of participants needs to be registered. The public has until midnight on this date to register. The following business morning the decision will be made as to whether or not the class will be held. If minimum registration has been met at this deadline, additional participants will be accepted until the day before the class starts, unless otherwise stated in the description.
If the minimum number of registrations has NOT been met by this date, the class will be cancelled. So please register early.
This is the first appearance a defendant makes in court. The judge will tell the defendant what the charge is, if the charge carries the possibility of a jail sentence, the judge will also set a date for a hearing of the case.
Pretrial supervision has been ordered by a judicial officer as a term of your release on bail. If you fail to comply your bail can be revoked and a capias can be issued for your arrest resulting in a return into custody.
The judge may allow you to set up a time payment program, based on your income.
A&F Districts are not to be confused with the Agricultural zoning district. A&F Districts are voluntary districts which agricultural landowners can enroll their land in. Once enrolled, A&F District properties cannot be developed for the time period during which the District is valid, usually for eight years.
The subdivision process is somewhat complex. Any division of land at all is a subdivision and will be subject to certain provisions of the Zoning and Subdivision Ordinances, INCLUDING Family Divisions. PLEASE CONTACT THE PLANNING AND ZONING OFFICE TO DISCUSS THE PARTICULARS OF YOUR SITUATION.
A misdemeanor is a crime punishable by a fine and no more than 12 months in jail. A felony is a crime that carries a potential prison sentence in the State Department of Corrections for one year or more.
The GIS is online and available to the public. We believe that the site is very user friendly, and we are always willing to walk you through it and give you tips and assistance. Click the link on our website that says
“Online GIS.” This will take you to a site hosted by MSAG Data Consultants. Once there, you can look up any property by tax map number, address or property owner’s name. You can see magisterial (voting) districts, zoning, topography, aerial photography and parcel information including owner, acreage and real estate tax value assessments. There is a wealth of information available and many ways to use the GIS.
CJS follows the County policy on closures. So, if the County is closed, then CJS will be closed. If you have a scheduled appointment and inclement weather occurs, then you should contact your officer the next business day to schedule another office visit. - Class 1 misdemeanor: Confinement in jail for not more than 12 months and a fine of not more than $2,500, either or both.
- Class 2 misdemeanor: Confinement in jail for not more than 6 months and a fine of not more than $1,000, either or both.
- Class 3 misdemeanor: A fine of not more than $500.
- Class 4 misdemeanor: A fine of not more than $250.
First, we should state that the Planning and Zoning Office, or Planning Staff, is made up of County employees working at the direction of the County Planning Director, John Egertson. Mr. Egertson and his staff are NOT the Planning Commission. The Planning Commission is a nine member body appointed by the Board of Supervisors. The creation of the Planning Commission and the duties it performs are state mandated. The Planning Commission is an advisory body which makes recommendations to the Board of Supervisors. The Board has granted authority to the Planning Commission to make final decisions on some land use applications, such as site plans. Generally however, the Planning Commission makes only a recommendation, and final authority to approve or deny applications lies with the Board of Supervisors.

Please bring a valid ID if you possess one, verification of your residence, and a copy of your recognizance/release paperwork. Additional documentation may be requested depending on your case.
You must have:
- A full description of the event that led you to seek a protective order. You will need this same information for the full hearing (where both parties are before the judge) that will be scheduled if a preliminary order is issued. You will be asked to testify at the full hearing (where both parties are before the judge) about the event that made you want to seek protection.
- The name and full address of the person from whom you are seeking protection - A full and complete address of the person is required, including an apartment number or unit number, not a P.O. Box.
- Any prior or existing protective orders you have in your possession, even if from another state or Virginia jurisdiction.
Other important information you should bring with you include:
- Any photographs, medical records related to the event that led to the petition for a Family Abuse Protective Order, or anything else you think will help prove your case
- The names and full addresses of anyone who witnessed the event
- As much identifying and contact information as possible about the person from whom you are seeking protection - This information is essential because the sheriff must be able to find this person for the protective order to take effect. Please provide:
- Name, nicknames, aliases
- Date of birth
- Home, work, cell phone, and pager numbers
- Addresses for home, work, friends, relatives, and places frequented
- Age, height, weight, eye color, hair color, distinguishing marks
- Social Security number
- Tendencies towards violence
- Information on ownership or possession of weapons, especially firearms
- A recent photograph of that person
- A copy of an Emergency Protective Order, if one was issued
- If possible, birth certificates and Social Security numbers for children for whom you may be seeking protection.
Emergency Protective Orders are most often issued by magistrates and may last only 72 hours.
The Magistrate's Office issues warrants and Emergency Protective Orders relating to family abuse, stalking offenses, and domestic assault offenses. If an Emergency Protective Order has expired before you are able to get to court and have your petition heard, you may ask the magistrate to issue another protective order.
A “respondent” is the person against whom the order is issued.
You will receive a copy of the order from the sheriff. Read the order carefully. Strict compliance with the order will avoid additional problems that can result in criminal penalties.
You may ask the court to dismiss or change the terms of the order. Only a judge may dismiss or change the terms.
The order will have a date and time for a hearing, arrive at the courthouse at least 30 minutes ahead to allow time for parking. You or your lawyer may tell your side of the case at the hearing.
If you feel you are in immediate danger, call 9-1-1 for law enforcement assistance.
The Board of Supervisors meet at the County Administration Building located at 302 North Main Street in Culpeper on the first Tuesday of every month at 10 a.m. and 7 p.m. Consult the Board's webpage for meeting agendas.
The court is open from 8:30 am to 4:30 pm, Monday through Friday except for holidays. You must first go to the Court Services Unit to complete a petition. From, there you will bring the petition to the Court and have it reviewed by a judge the same day, if timely possible. (A petition is a formal written request asking the court to take a certain action on a matter.)
When your case is finalized by the court. Reporting schedules depend on your specific situation but typically range from once per week to once per month. Reporting details will be explained at greater detail during the intake. Your officer will attempt to accommodate your schedule within agency guidelines.

There are three private pools available in Culpeper County; Powell Wellness Center, Culpeper Country Club, and Culpeper Recreation Club. Memberships are required.
The Planning and Zoning Office keeps copies of plats that we approve. We keep them in a digital format, and our older paper copies are gradually being scanned into digital format. If we have a plat of your property, we will be happy to print a copy for you for a small fee. Keep in mind that we do not have a complete record of all plats. In the event that we do not have what you need, the next place to look would be the records room in the Circuit Court Clerk’s Office, at the Courthouse. If all you need is a general look at your property as it relates to the properties around you, use our GIS system (see below).
The keeping of horses, or any livestock, is limited to the A‐1 and RA zoning districts, although there are numerous ‘grandfathered’ situations and a use permit can be obtained for such uses in the R‐1 zoning district. There is no limitation to the number of animals which can be kept per acre.

Retailers of batteries are required to accept your old battery IF you are purchasing a new battery from them. Contact your local auto parts store for more information.

Alkaline Batteries can be disposed of in your normal household trash.
Rechargeable Batteries are recyclable through the RBRC (Rechargeable Battery Recycling Corporation). They recycle the following battery chemistries: Nickel Cadmium (Ni-Cd), Nickel Metal Hydride (Ni-MH), Lithium Ion (Li-ion) and Small Sealed Lead* (Pb). They have drop-off locations in many cities across the Country.
